University Senate Judicial Board Jurisdiction over disputes and appeals

Type of dispute Initial Jurisdiction Appeals 

Disputes involving faculty members and questions of academic freedom, tenure rights, dismissal, appointment, promotion, reappointment, and non-reappointment, or any other Faculty Right enumerated in Article III of the Code of Faculty Rights, Responsibilities and Conduct. (USRR 6.4.1)

Faculty Rights Board is the hearing body. (USRR 6.4.1.1) 

No appeal is available from a decision made by FRB.
 (USRR 6.4.1.2)

Disputes involving questions of  any faculty right, as enumerated in Article III of the Code of Faculty Rights, Responsibilities and Conduct, that leads to a sanction of a faculty member.  (USRR 6.4.2) 
Faculty Rights Board (FRB) is the Hearing Body for appeals of faculty rights and major sanctions.  (USRR 6.4.2.1)
No appeal is available from a decision made by fRB (USRR 6.4.2.3) 
 
Hearing Panel of the Judicial Board. (USRR 6.4.2.2)  Judicial Board Appeal Panel may hear an appeal of a Judicial Board initial hearing, involving minor sanctions. (USRR 6.4.2.3)

Disputes involving alleged academic misconduct by faculty or students and alleged violations of student rights by faculty or staff.
(USRR 6.4.3)

Unit level grievance procedures, or a Judicial Board hearing panel may hear at the unit level if both parties agree (USRR 6.4.3.1) , and the Judicial Board Chair rules that the Judicial Board Hearing Panel may hear (USRR 6.5.2) 

Judicial Board Appeal Panel may hear an appeal from either a unit level or Judicial Hearing Board.  (USRR 6.4.3.2)

Grade Appeals (USRR 6.4.4)

Hearing at Unit level (USRR 6.4.4.1)

A Judicial Board Appeal Panel may consider an appeal.   (USRR 6.4.4.2)

Disputes involving allegations of discrimination (USRR 6.4.5.)

IOA Conducts Investigation.  (USRR 6.4.5.1)

Parties may appeal to the administrative officer or body appropriate to the individual’s status within the University.

An appeals panel of the Judicial Board may consider the appeal (USRR 6.4.7.2 and 6.9.6) 

Disputes involving alleged violations by a student of the Code of Student Rights and Responsibilities (nonacademic misconduct). (USRR 6.4.9)

A Judicial board Appeal panel may consider an appeal. (USRR 6.4.9.2)

Disputes involving violations by a student of the Student Senate Election Code(USRR 6.4.10)

Hearing with Student Election Commission
 (USRR 6.4.10.1)

Appeal: A Judicial Board Appeal panel may consider an appeal .

The Judicial Board does not have Jurisdiction for:
USRR 6.4.6: Summons or citation for violation of parking and traffic rules
USRR 6.4.8: Disputes involving Library Fines
USRR 6.4.11: Disputes involving rights and responsibilities under the Family Educational Rights and Privacy Act ("Buckley Amendment.")
USRR 6.4.12: Disputes involving alleged violations of Department of Student Housing policies 
USRR 6.4.13: Disputes involving classification as a non-resident student for fee purposes
USRR 6.4.14: Disputes involving assessment or refunds of tuition and fees
USRR 6.4.15: Disputes involving employment-related issues of Unclassified Professional Staff members
USRR 6.4.16:Disputes involving employment-related issues of Graduate Teaching Assistants
